This Liability Waiver and Media Release ("Agreement") governs participation in all classes, free trials, seminars, camps, events, and other activities offered by 4 Korners Jiu-Jitsu, a martial arts academy operated by Ashon LLC (collectively referred to as "4KBJJ," "we," "us," or "our") at its facilities in Texas and at any off-site events.

By attending, enrolling in, or otherwise participating in any 4KBJJ activity — whether in person or booked online — you agree to be bound by all terms of this Agreement. No signature is required; participation constitutes acceptance. If you do not agree, do not participate.

Express Negligence & Release Statement

Texas law requires that any waiver of liability for negligence be stated expressly and conspicuously. The following statement satisfies that requirement:

By participating in any 4KBJJ activity, you expressly release, discharge, and waive all claims against 4 Korners Jiu-Jitsu and Ashon LLC — including claims arising from the negligence of 4 Korners Jiu-Jitsu, Ashon LLC, their owners, officers, instructors, employees, contractors, and agents — for any injury, loss, or damage to your person or property, whether foreseeable or not.

This release of negligence is a material term of this Agreement. If you do not accept it, do not participate in any 4KBJJ program or activity.

Health & Physical Condition

Important

If you have any medical condition, physical limitation, or health concern that may affect your ability to train safely, please consult a physician before participating.

By participating, you confirm that you are not aware of any medical condition that would preclude you from safely taking part in Brazilian Jiu-Jitsu, boxing, martial arts, or related activities offered by 4KBJJ. You agree to:

  1. Stop immediately if you experience pain, dizziness, shortness of breath, light-headedness, or any other concerning symptom during training, and notify an instructor right away.
  2. Follow all instructor directions at all times. If you do not understand an instruction or technique, ask for clarification before attempting it.
  3. Decline to participate in any activity you do not feel physically capable of performing safely. You will not be pressured to attempt anything beyond your current ability or comfort level.
  4. Not train while ill, injured, or impaired. Do not attend class if you are sick, significantly injured, or under the influence of alcohol or any substance that may impair your judgment or coordination.

Assumption of Risk

Brazilian Jiu-Jitsu, boxing, and martial arts training involve physical contact and inherent risk of injury. Risks include, but are not limited to: bruises, strains, sprains, dislocations, fractures, torn muscles or ligaments, concussion, nerve damage, and in extreme cases, paralysis or death. These risks exist even when all participants and instructors exercise reasonable care.

These injuries may result from your own actions, the actions or inactions of other students, or the actions or inactions of instructors.

By participating in any class, free trial, seminar, camp, or event offered by 4KBJJ, you voluntarily and knowingly assume all risks associated with martial arts training — including all injuries, costs, and damages that may result, whether caused in whole or in part by yourself, other students, instructors, or 4KBJJ staff.

Indemnification & Hold Harmless

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless 4 Korners Jiu-Jitsu and Ashon LLC — including their owners, officers, instructors, employees, contractors, and agents — from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  1. Your participation in any training activity, class, event, or program;
  2. Any injury to yourself or damage to your property occurring on 4KBJJ premises or during 4KBJJ activities; or
  3. Any act or omission by you that causes harm to another student, instructor, or guest.

This indemnification applies even where a claim alleges partial negligence on the part of 4KBJJ or its representatives, except where such liability is expressly prohibited from exclusion by law.

General Release of Liability

On behalf of yourself, your heirs, executors, administrators, and assigns, you hereby release, discharge, and hold harmless 4 Korners Jiu-Jitsu, Ashon LLC, their representatives, agents, and instructors from any and all claims, actions, or demands for injury, loss, or damage to your person or property, arising out of or in connection with your participation in any 4KBJJ class, trial, seminar, camp, or related activity.

This release expressly includes claims arising from the negligence of 4KBJJ, Ashon LLC, or their representatives, to the fullest extent permitted by Texas law.

Minors & Parental Consent

Important — Texas Law on Minor Waivers

Under Texas law, a parent or guardian may not waive a minor child's own personal injury claims (such as pain and suffering). This Agreement waives the parent's or guardian's own economic claims (such as medical expenses) to the fullest extent permitted by law. The minor's personal injury claims are not waived by this Agreement.

If you are enrolling a minor (any person under 18 years of age), by booking or bringing that minor to any 4KBJJ activity you confirm that:

  1. You are the minor's parent or legal guardian with full legal authority to act on their behalf;
  2. You have read and agree to all terms of this Agreement on the minor's behalf;
  3. You accept all obligations described in this Agreement, including the assumption of risk, indemnification, and release of your own claims; and
  4. You understand that this Agreement binds you, your heirs, assigns, executors, and administrators with respect to your own claims, but does not extinguish the minor's independent personal injury claims under Texas law.

Protective Equipment

Participants are responsible for supplying their own protective equipment as required or recommended for their specific program (e.g., mouthguards, rash guards, gi, boxing gloves). 4KBJJ staff may advise on required or recommended gear, but 4KBJJ is not responsible for providing personal protective equipment to students. Use of 4KBJJ-owned equipment, if any, is at the participant's own risk.

Facility Use & Access

Your use of 4KBJJ facilities, training programs, and equipment is undertaken entirely at your own risk. In exchange for access to our facility and programs, you agree to the terms set forth in this Agreement.

4 Korners Jiu-Jitsu and Ashon LLC reserve the right to close the facility, suspend operations, or modify training programs at any time without prior notice, for any reason including safety concerns, maintenance, or other operational needs. No refunds will be issued solely on the basis of a temporary closure, except as required by applicable law or as specified in your membership agreement.

Photography & Media Release

Classes, seminars, tournaments, camps, and other 4KBJJ events may be photographed or recorded for promotional, educational, and social media purposes.

By participating in any 4KBJJ program, you grant 4 Korners Jiu-Jitsu and Ashon LLC a non-exclusive, royalty-free, perpetual license to use, reproduce, and publish photographs, videos, and other media in which you (or your minor child) appear, for purposes including:

  1. Marketing and promotional materials (print and digital);
  2. Social media content on 4KBJJ's official channels;
  3. Website and online content; and
  4. Internal training and educational purposes.

You waive the right to inspect or approve any photograph or video prior to publication, and release 4KBJJ and any party acting with its permission from any liability arising from the publication of such media.

Opt-Out: If you do not consent to the use of your or your child's likeness, you must notify us in writing at 4kornersbjj@gmail.com before attending your first class. Opt-out requests received after participation begins apply prospectively only.

Governing Law & Disputes

This Agreement is governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute arising from or relating to this Agreement or your participation in 4KBJJ activities shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings held in Collin County, Texas.

You waive any right to participate in a class action lawsuit or class-wide arbitration against 4 Korners Jiu-Jitsu or Ashon LLC.

If any provision of this Agreement is found to be unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remainder of the Agreement shall continue in full force and effect.

By attending a class, free trial, camp, seminar, or any other 4KBJJ activity — whether in person or booked online — you acknowledge that you have read, understood, and agree to all terms on this page. No signature is required; participation constitutes acceptance.

This Agreement applies to all students, guests, and visitors, including parents or legal guardians acting on behalf of a minor. It is binding on you, your heirs, executors, administrators, and assigns.
